Final Order / Judgement

Present :  Sh.Ravinder Singh, husband of the complainant

                Counsel for the opposite parties

         

1.       Counsel for the opposite party Sh.Sumit Sharma suffered a statement that as per the instructions from the Insurance company, opposite parties are ready to refund the premium amount of the policy in question to the tune of Rs. 99,110/- within a period of 30 days on return of original policy alongwith letter to cancel the policy in question from the policy holder. At this stage Sh.Ravinder Singh, authorized representative  of the complainant also suffered a statement that he has heard the statement of the counsel for the opposite party and has accepted the same. However, he pressed for compensation and litigation expenses.

2.       A perusal of the file shows that the instant complaint has been suffered on 21.7.2016 and the same has been pending disposal since then. The complainant had to file the instant complaint and had incurred expenses on the same and the complainant has been attending the court proceedings since then continuously. As such the complainant is also entitled to compensation as well as cost of litigation for deficiency in service on the part of the opposite parties besides refund of Rs. 99,110/- as promised  by the counsel for the opposite parties after return of original policy, letter to cancel the policy from the policy holder. However, complainant has demanded compensation to the tune of Rs. 3000/-.

3.       Consequently, in view of the abovesaid statement, complainant is allowed compensation of Rs. 3000/- besides cost of litigation Rs. 2000/-. Copies of the order be furnished to the parties free of costs. File is ordered to be consigned to the record room.
