CC No.266 of 2019.

Sanjay Kumar Jain vs. Shri Ram General Insurance Co. Ltd.

 

                       Present:     Sh.SP Panwar, Adv. for complainant.

                                         Sh.Ajay Shakti Goel, Adv. for respondents.

 

                                    On the basis of even dated application filed by Sh.SP Panwar, Adv. for complainant, file taken up on today. The parties have entered into amicable settlement.  Sh.Ajay Shakti Goel, Adv. for opponents is also present before this Commission and he has not disputed the settlement between the parties.  According to his statement opponent No.1 is agreed to make payment of Rs.40000/- (Forty Thousand) only as full and final settlement of the matter within the period of 30 days.  Counsel for the complainant agreed to it.

                                      In view of the amicable settlement of matter between the parties, without making any adverse comment on the act and conduct of the opponent No.1, the present complaint is accepted against opponent No.1, holding it liable to make payment of Rs.40000/- (Forty Thousand) only as full and final settlement of the claim to the complainant within the period of 30 days from the date of order.  In default of it, award amount Rs.40000/- shall carry on interest @7% p.a. from the date of order till actual realization. The opponent No.1 is local branch office of the opponent No.2 and in the eyes of law, both the opponents are one and same thing, so no separate order qua liability of opponent No.2 is required to be passed. Complaint qua opponent No.2 is liable to be dismissed and is dismissed as such.  The parties are left to bear their own costs of litigation.
