ORDER

Learned counsel for the OP/respondent i.e. OP-Insurance Company tendered a statement before the Commission, which is as under:

“Stated that the parties to the present complaint have arrived at compromise. A sum insured in this case is Rs.4,60,000/- and a sum of Rs.2,49,700/- is to be paid OP/insurance Company as per compromise and the Op/insurance company is ready to pay the above amount and shall the pay the same within  45 days”

                  Learned counsel for the complainant also made a statement which is as under:      

“Stated that keeping in view the statement made by learned counsel for OP/insurance I do not want to proceed further with the present complaint and withdraw the same”.

                        In view of the statements so tendered by both the parties, the present complaint is disposed off with a direction to the OP-Insurance Company to pay a sum of Rs.2,49,700/- to the complainant within 45 days from today, failing which OP-Insurance Company shall be liable to pay interest at the rate of 12 % per annum for the period of default. Accordingly, the present complaint stands disposed off. Both the parties shall remain bound by their respective statements. Copy of this order be supplied to the parties free of costs. File be consigned to the record room after due compliance.
