Today, the case is fixed for filing rejoinder by the complainant, however the learned counsel for the opposite party has made a statement recorded separately that the insurance company offers a sum of Rs.1,80,000/- as full and final settlement of the claim of the complainant and that the insurance company will pay the said amount through cheque in the name of complainant within one month from the date of receipt of copy of the order. The learned counsel for the opposite party has also suffered statement that he has heard the offer of the insurance company and the same is acceptable to the complainant and also stated that the complaint may kindly be dismissed as withdrawn.

In view of the aforesaid statements of learned counsel for the parties, the present complaint is dismissed as withdrawn. However, the parties would be bound by their statements. File be consigned to the record room.
