1.       None for the appellant is present, it’s counsel Shri. R.B.Deshmukh is also absent. None for the respondent is also present it’s counsel Shri. R.P.Adgaonkar is also absent. However, proxy Adv.Shri.Vinod P.Patil  appeared with authority letter of Adv.Shri.Adgaonkar  for the respondent.  On the last date nobody for the appellant was present on earlier date proxy Adv.Shri.R.R.Deshmukh appeared on behalf of Adv.Shri.R.B.Deshmukh and sought time but thereafter nobody for the appellant turned up. However, on last date the matter was adjourned till today as a last chance but  today nobody for the appellant is present. Hence, the appeal deserves to be dismissed in default.

2.         Moreover, we have gone through the copy of the impugned judgment and order and we find that the impugned judgment and order is just proper and legal. Hence the appeal is dismissed. No order as to cost.
