1. None for the appellant is present, its counsel Shri.G.A.Gade is also absent. Both the respondents as well as their counsel are absent. However, proxy Adv.Shri. V.D.Dhage appeared with authority letter of Adv.Shri. Rahul Joshi for the respondents. On last date also appellant as well as his counsel were absent. However, the matter was adjourned till today by way of last chance but today nobody for the appellant is present. Therefore the appeal deserves to be dismissed in default.

2. Moreover we have perused the copy of impugned judgment and order and we find that the impugned judgment and order is just and legal . Hence, on any count the appeal deserves to be dismissed and accordingly it is dismissed. No order as to cost.
