Adv.Smt.S.S.Medhekar for the appellant is present. Respondent Shri. Chandrakant Baburao Gaware is reported to be dead. Accordingly, it was informed by the proxy Adv. Bhujbal holding for Adv. Nitin Bhavar for the respondent. But no steps are taken by the appellant to bring L.R’s on record. As per information given by the proxy advocate respondent expired on 03/08/2009. Copy of the death certificate is produced today by Shri.Avinash Patil. Therefore, the appeal being abated stand dismissed.
