None is present for the appellant. Adv.Shri.U.N.Shete is present for the respondent and submitted that since last so many dates none is present for the appellant and hence appeal may be dismissed. He further submitted that in the daily proceeding of dates 09/12/2011 and  13/07/2012  he is wrongly shown as appeared for the appellant.  Perusal of the earlier proceeding shows that Adv.Shri.K.G.Sakhare filed V.P. for the appellant on 25/07/2008 along with appeal memo. But none  appeared for the appellant on 08/12/2010, 09/12/2011, 13/07/2012 and 29/08/2012. Last chance was also given on 29/08/2012  for final hearing. Today also none is present for the appellant. Hence, we are satisfied that appellant is not interested in perusing the appeal. Appeal is therefore dismissed in default.
