Per Hon’ble Justice Mr.R.C. Chavan – President:
1. The parties have filed compromise pursis stating that they are settling the matter amicably. The appeal is therefore disposed of in terms of joint compromise pursis filed by the parties. The terms of compromise pursis are as under:-
(i) Agreed, declared and confirmed by the appellant and the respondent that the appellant has no objection to the respondent withdrawing the sum of Rs.1,83,000/- (Rupees one lakh eight three thousand only) as deposited by the appellant with the Consumer Disputes Redressal Forum, situate at Thane, pursuant to the order passed by this Hon’ble Commission, along with accrued interest, till date, and/or till the date of the withdrawal of the amount.
(ii) That the Hon’ble Commission may kindly consider passing an order permitting the State Bank of India, Dahej Branch (Branch Code: 07234), Gujarat to debit the Account Number: 20068982513 of Mr.Sanjay Roy, the fraudster maintained by the State Bank of India, Maniktala Civil Centre (07468) Branch, situate at Kolkata by a sum of Rs.1,83,000/- (Rupees One Lakh Eight Three Thousand only), along with accrued interest.
(iii) Agreed, Declared and confirmed that the appellant and the respondent agree to amicably settle the dispute in the present appeal and pursuant thereto the appellant is withdrawing the present appeal unconditionally.
2. It is further clarified that appellant bank is permitted to make debit of an amount of Rs.1,83,000/- to the account no.20068982513.
3. District Forum may pay the amount deposited along with accrued interest to the original complainant.
