Heard Mr.Suryakant Moye –complainant in person.  Dr.M.S.Kamath-A.R. for the complainant. Ms.Rajni Iyyer –Sr.Counsel i/b. Mr.A.V.Patwardhan-Advocate for Dr.R.C.Patel. Mr.Dey-A.R. &  Mrs.Anita A.Marathe-Advocate i/b.Kanga & Co. for Bombay Hospital & Medical Research Centre.

Initially, respondent no.1 had filed consumer complaint no.632/1998 before the South Mumbai District Forum.  Said complaint was decided in favour of respondent no.1- Mr.Suryakant A. Moye.  In the said complaint, opponent no.1 was Dr.R.C.Patel and the Trustees of the Bombay Hospital & Medical Research Centre were the opponent no.2.  Being aggrieved and dissatisfied with the said order, the original opponent no.1-Dr.R.C.Patel has preferred Appeal no.1342/2003, so also original opponent no.2 preferred another Appeal no.1406/2003.  In both the appeals respondent no.1 is an original complainant.

Both these appeals have been settled by the complainant and opponent nos.1&2 and the consent terms have been arrived at.  Those consent terms are presented today in the State Commission.  Parties are present duly represented through their advocates and authorized representative.  The consent terms have been signed by the parties. They accept that they have voluntarily entered into the consent terms.  In view of this both the appeals are disposed of in terms of consent terms.  Consent terms are marked as ‘Exhibit X’ for identification and shall be kept along with this order.
