ORDER

The instant appeal is preferred by the appellant-HDFC Life Insurance Company Ltd. against the judgment dated 26.07.2019 passed by the learned District Forum, West Tripura, Agartala in Case No.C.C.45 of 2018 along with an application for condoning the delay of 82 days in preferring the appeal.

The appellant-Insurance Company also deposited the statutory deposit amounting to Rs.25,000/-.

Today the matter is listed for order.

When the matter is taken up, Mr. Sampad Choudhury, Ld. Advocate for the appellant-petitioner submits that as the judgment impugned in the instant appeal is also under challenge in Appeal No.A/23/2019 which is already been settled amicably by the parties outside the Commission and disposed of by this Commission in terms of the compromise petition the appellant-petitioner, HDFC Life Insurance Company Ltd. is not pressing the instant appeal.

In view of the above, the instant appeal is disposed of as not pressed.

Appellant-Insurance Company is at liberty to withdraw the statutory deposit, if so advised.

Office is directed to release the statutory deposit amounting to Rs.25,000/- in favour of the appellant-HDFC Life Insurance Company Limited by issuing an A/C payee cheque and the same may be handed over to the competent authorized person of the appellant-HDFC Life Insurance Company Limited on proper receipt and identification by its Ld. recorded Advocate.

Copy of this order be furnished to the Ld. Counsel for the appellant-petitioner.
