None present for the appellant and the respondent No. 1 & 2. Perusal of the daily proceeding shows that after the appeal came to be transferred from State Commission Mumbai to this Commission, none appeared for the appellant and the respodnent till this date. The appeal was adjourned form 15.03.2010 till this date twelve times. The appellant failed to appear on any of the aforesaid dates. this Commission suo moto issued notices to both the parties, twice i.e. on 25.04.2012 and 27.06.2012. The said notice issued to apelalnt as well as both the respondent returned unserved. As per postal endorsement the appellant refused to take the notice. Moreover the Resp. No.2 also refused to take the notice. The Resp. No.1 is found dead. No steps are taken by the appelant for bringing LR's on record.

Thus as the appellant refused to taken the notice, it is deemed service of notice to him. As appellant as not appered after service of that notice, we are satisfied  that it is not interested in pursuing the appeal. Appeal is dismissed in default.
