     Adv. Mr Umak for the applicant present.  Adv. Mr Deshpande is appearing for Non-applicant but today he is absent. 

 

     We heard Adv. Mr Umak.  We find that original appeal No.A/06/1142 was dismissed in default by this Circuit Bench on 05.09.2007 and the order was received by the appellant on 09.10.2007.  Thereafter, this Misc. Application is filed for restoration of appeal.  In the meantime appellant expired, hence his son has filed this application for restoration of appeal to the file. 

 

     We find that applicant, after receipt of dismissal order on 09.10.2007 and filed this restoration application on 24.10.2007 i.e. within limitation, therefore, we restore the appeal No. A/06/1142 to its file.

 

      Inform the parties accordingly. 

 

     Appeal No.A/06/1142 be kept for hearing on 11/10/2011.
