None for the Respondent.

         Respondent is duly served who is absent.  Hence there is proper service.   This Misc.Application is filed for restoration of appeal no.1068/2007 which was dismissed for default on 30.09.2008.  Immediately on the next day this Misc.application came to be filed.  Since just and sufficient cause has been shown and since non-applicant is not contesting this Misc.application for restoration, we are inclined to allow this Misc.application to restore back to file.  Hence, we pass the following order:

O  R  D  E  R

    (i)               Misc.Application No.1846/2008 is allowed.

  (ii)               Subject to costs of `1,000/- to be deposited in Legal Aid Fund of this Commission, the Appeal No.1068/2007 is restored back to file.

(iii)               We direct Issue of notice to Respondent informing that the appeal has been restored back to file and next date of hearing.

(iv)               Notice through Commission and private notice of Advocate, both are permissible. 

  (v)               Appeal stands adjourned to 21.02.2011.
