The facts as made out in the complaint are that the complainant sought admission in MBA degree course to be provided by Western Trinity University of U.K. from the OP institute and he deposited Rs. 500/- in cash for prospectus and application form and Rs. 25,000/- towards course fees on 13.7.13 but ultimately the OP decided to change the admission course from a degree MBA to PGDM which is a diploma course without any prior intimation. Pleading deficiency in service and unfair trade practice the complainant has filed the present complaint for directing the OP to refund the amount of Rs. 25,000/- along with 24% interest, to pay Rs. 25,000/- for the mental agony and harassment and Rs. 25,000/- as litigation charges to her.
OP is proceeded exparte vide order dated 06.03.2014 passed by our predecessors.
The complainant has filed exparte evidence.
We have heard the counsel for the complainant and have also carefully gone through the file.
Grievance of the complainant is that without giving any information to him, OP institute had changed the course from MBA degree course to PGDM which is a diploma course. However, he has made a reliance on letter dated 28.7.2013 issued by the OP institute. We mark the said letter as Mark A. The said letter has been written by the OP to the complainant. Relevant portion of the letter reads as under:
“We are pleased to inform you that you have cleared our interview for our two year full time PGDM Program (2013-15) approved by All India Council for Technical Education (AICTE) which is our main course and MBA from Western Trinity University is a credit transfer program which we are providing based on your performance in 1st year. You shall be required to produce the following documents in ORIGINAL:
- Provisional offer letter for admission;
- MAT Score card for admission to PGDM Program;
- The original and attested copy of the marks-sheet of High School, Intermediate and Graduation (in case the Final Graduation result has not been declared till the date of registration. You may be permitted to submit the results till November 30, 2013, failing which the admission will stand cancelled. However, you must have completed all the requirements of the qualifying degree on the date of registration. The admission will remain provisional until you submit the results indicating successful completion of the requirements of the qualifying degree on the date of registration. - In addition you need to submit your Migration Certificate and Transfer Certificate before joining the institute failing which your offer of admission made will stand lapsed unless additional time is allocated to you for this purpose. Your admission will be confirmed only after you submit Final Graduation Mark Sheet along with original Migration certificate.
Hostel accommodation is compulsory for outstation girl candidate. Please note that all the selected students and their parents have to agree and sign on the rules and regulations duly laid in a separate form.
It may please be noted that this admission offer is purely provisional and is contingent to the Candidate’s meeting all the requirements, conditions and guidelines for admission to the program as stipulated by AICTE, or any other rules/regulations/decisions of the Institute in this regard. The institute reserves the right to withhold the result/cancel the admission at any time during your stay at the Institute, due to your submitting false information/facts.” (Emphasis supplied)
Thus, it is clear that the complainant had been duly informed that the MBA course was a credit transfer program and not a direct course. Therefore, we hold that while giving admission to the complainant in the said course the OP did not conceal any facts from him.
In view of the above discussion, we do not find any merit in the complaint. Accordingly, we dismiss the complaint with no order as to costs.
Let a copy of this order be sent to the parties as per regulation 21 of the Consumer Protection Regulations. Thereafter file be consigned to record room.
