Per Justice Shri S.B.Mhase, Hon’ble President:

This appeal is directed as against the order passed by District Consumer Disputes Redressal Forum, Raigad in consumer complaint no. 22/2008 decided on 13/01/2009.  By the said order the complaint filed by the appellant has been dismissed. Therefore, org. complainants  has filed the this appeal.  In this appeal the org.opponents are the respondents.

          This appeal has been filed by the complainant through Advocates

Shri B.T.Navale, Rachana K. Bhate and Priya S.Parange.  Thus, the complainant has engaged three advocates.  The appeal has been filed on 24/02/2009.  It was listed for admission on 27/08/2009.  On 27/08/2009 when the appeal was called, no one was present for the appellant that means all the three advocates and appellants were absent.  It appears that after filing of the appeal Adv.Navale has sent notice to the respondents informing the date that the appeal is coming before State Commission on 27/08/2009.  By the said notice only copy of the appeal memo has been served but rest of the compilation was not served on the respondent.  The respondent – Prakash Bidavi appeared on that day and he waived the notice.  Thereafter, the appeal appeared on 18/01/2010.  On 18/01/2010 also no one  was present for the appellant.  However, the respondent was present.  He was directed to file power of attorney for the rest of the respondents and it was adjourned to 10/06/2010.  On 10/06/2010 the Commission was busy in old matters and therefore, it was adjourned to 05/08/2010 i.e. today.  Today all the three advocates for the appellant are absent.  Respondent/ Prakash Bidwi is present. 

Under these circumstances, we find that appellant is not interested in prosecuting the appeal.  The appellants and their advocate are continuously absent as stated above.  Hence, we pass the following order:-

1.                 Appeal stands dismissed for non-prosecution.

2.                 No order as to costs.

3.                 Dictated on dais.

4.                 Copies of the order herein be furnished to the parties.
