Per Shri P.N. Kashalkar, Hon’ble Presiding Judicial Member

          None is present for the appellant.  On 22/03/2010 appellant was permitted to effect service on the respondent by issuing Public Notice in the widely circulated newspaper of District Nashik.  Then on 11/06/2010 the appellant/Bank expressed its inability of publishing notice as per order dated 22/03/2010 and requested for extension of time.  It was granted subject to cost of `2,500/- to be deposited in the Consumer Legal Aid Fund of this Commission.  Again on 12/087/2010 same lapse continued and therefore, further cost of `5,000/- was imposed and time was granted to publish public notice as already directed against the respondent.  Again on 19/11/2010 it was found that further cost of `500/- was imposed for non-compliance of our order and appellant was directed to issue public notice.  Today, neither the compliance of this order has been made nor from the record, it is reflected that costs have been paid.  In the circumstances, this conduct of the appellant shows that appellant is not interested to prosecute this appeal.  We therefore pass the following order :-

                             -: ORDER :-

1.       Appeal stands dismissed for default and for non-compliance.

2.       No order as to costs.

3.       Copies of the order be furnished to the parties.
