ORDER

Heard both sides on delay condonation application.

 

         There is 34 days delay in filing this appeal and therefore, this application is filed for condonation of delay.  In the instant case the Forum below upheld the contention of the Applicant that there is a breach of utmost good faith of suppressing the previous illness and proceeded further to grant compensation.  This substantial question of law needs to be addressed therein.  In this background, we find that delay as explained in paragraph-5 of the application is properly explained and holding accordingly, we pass the following order:

1.  Application is allowed.

 

2.  Delay in filing this appeal stands condoned.
