Present:                    Shri Mohd Asif Khan counsel for DH

He has filed the present execution. However, inadvertently, this office has registered this as CC/134/2022. It is ordered that present matter i.e. CC/134/2022 is cancelled and this matter be registered as execution by giving fresh execution number. As far as CC/134/2022 is concerned it was stand deleted/deemed to have been deleted from office record.

On 11.04.2013, order was passed by this Forum and thereafter, the OP went to in appeal which has been decided on 5.4.2021 by Hon’ble State Commission with following relief to DH–

            Pay Rs. 5,00,000/- to the DH alongwith a sum of Rs.10,000/- towards cost and Rs. 33,750/- towards interest @9% on the said amount w.e.f. 1.7.2021 till 1.3.2022, hence totaling to Rs. 5,43,750/- till 1.3.2022. The JD is further bound and liable to pay the interest @9% w.e.f. 1.4.2022 till its realization.

            Since one year has not passed from the date of final order, issue warrant of attachment in terms of para 7 through S.H.O. Krishna Nagar subject to filing of affidavit  by DH that he has not received any notice of further appeal in this matter and also the calculation sheet.
