ORDER

 

 

  1. The present appeal has been preferred by M/s BPTP Ltd. for challenging the order dated 11.07.2023 passed by the District Consumer Commission Disputes Redressal Commission, Rohtak whereby complaint preferred by the complainants Ram Niwas Hooda, Azad Singh Malik and Ajit Singh was allowed and the opposite party was directed to hand over the possession of flat/floor to the complainants within one month and also to pay interest @9% p.a. upon the amount deposited by the complainants with the opposite party from the date of settlement deed dated 11.08.2022 till handing over the actual physical possession to the complainants. The opposite party was also directed to hand over the relevant documents required for sale i.e. to issued permission to transfer letter and other required documents for sale to the complainants within a week from the date of order. The opposite party was also directed to pay a sum of Rs.10,000/- as compensation and Rs.5,000/- as litigation expenses to the complainants.
  2. On the previous date, notice of the appeal was issued to the respondent through registered post.
  3. Proxy counsel appearing for the appellant states that during the pendency of the present appeal, parties have amicably settled the matter and accordingly, the appellant wishes to withdraw the appeal.
  4. In view of the above, the appeal is disposed of as having been withdrawn.
  5. Application(s) pending, if any, stand disposed of in terms of the aforesaid order.
  6. A copy of this order be provided to all the parties free of cost as mandated by the law. The order be uploaded forthwith on the website of the Commission for the perusal of the parties.
  7. Statutory amount of Rs.4,09,435/- (Rs. Four Lakh Nine Thousand Four Hundred Thirty Five only) deposited by the opposite party at the time of filing of present appeal be refunded to the appellant against proper receipt, identification and as per rules.
  8. File be consigned to record room along with a copy of this order.
