File taken up on the application moved by complainant for granting permission for record settlement and dispose of the matter.
Ld. counsel for the opposite party No. 1 made a statement that their full and final settlement has been effected with the complainant in Rs.2,80,989/-(Rupees two lakhs eighty thousand nine hundred eighty nine only) and the same will be paid to the complainant within 60 days. He further submitted that they received original letter which is written by complainant to RTO for cancelling the RC and copy of NOC of Mahindra Finance and Form No. 35 from the complainant.
Ld. counsel for the complainant made a statement that he agrees with the above statement and has no objection to decide the case accordingly. He further submitted that if the complainant received cancellation of RC in future then they submits it in the Company.
In view of the statements made above by both parties, present complaint is hereby disposed off/settled with direction to the opposite parties to pay the alleged amount of Rs.2,80,989/-(Rupees Two lakhs eighty thousand nine hundred eighty nine only) to the complainant within 60 days, failing which opposite parties shall be liable to pay interest @ 9% per annum from today i.e. 04.08.2023 till its realization to the complainant. Parties shall be bound by their respective statements. Copy of this order be supplied to the parties free of cost.
File be consigned to the record room after due compliance.
