ORDER

Per Shri P.N. Kashalkar, Hon’ble Presiding Judicial Member

          This is an application seeking restoration of appeal which was dismissed for default on 30/06/2010 on finding that the appellants were not present to argue the appeal.  This restoration application came to be filed on 20/09/2010.  Counsel for the non-applicants has no objection for allowing this application.  Both parties want that main appeal should be decided on merits.  In the circumstances, subject to certain costs, we allow this application to restore the appeal back to file.  Hence, we pass the following order :-

                   -: ORDER :-

1.       Application is allowed.  Appeal No.495/2010 is restored back to file subject to cost of `2,000/- payable by the    applicants/appellants to the respondents.  Cost is paid today to the respondents.

2.       Appeal No.495/2010 stands adjourned to 08/02/2011 for admission.
