As per Hon’ble President, Mr. Atul D. Alshi.

          The non-bailable warrant issued against OP/ Accused o n 13/08/2021 returned back with endorsement the OP/ accused is dead. The complaint has failed to take the steps in the matter. The prosecution can’t be continued against the legal heir if any. Hence at this stage the case is disposed off.

Counsel for Complainant filed the pursis on record submitting that the matter be disposed as O.P. is died. Counsel for complainant has not taken any steps. Hence the matter is disposed off as dismissed. 

                                                               ORDER

       1)      Execution Application disposed off  as complaint has failed to take the steps

                 in the matter.

       2)      No order as to costs.

       3)      Certified copy of this order be supplied to both parties free of cost.
