None is present for the appellant. Resp. Pradeep Banubakode is present in person. He submits that appeal may be dismissed as the appellant neither paid cost of Rs.500/- to him as per direction given on last date nor remained present today for final hearing. Perusal of R&P shows that adv. for the appellant appeared lastly on 20/12/13 and he had sought adj.for filing WNA. The appeal was then adjourned to 15/4/14 but none appeared for the appellant on that date. Moreover, he has not  filed WNA. Therefore, last chance was granted to the appellant subject to payment of cost of Rs.500/- to the respondent. The said cost is not yet paid to the respondent and the WNA is also not yet filed. Therefore, the appeal deserves to be dismissed in default. Appeal be recalled at 3.00 p.m. for order.

The matter is recalled at 3.30 p.m. today. Presently also none appeared for the appellant though the respondent is present in person. Hence the appeal is dismissed in default.
