Per Mr S M Shembole, Hon’ble Presiding Member


           Appellant Dr. Mrs. Aruna Ranade as well as her counsel Mr Uday Dastane are absent. Respondent Nos. 1 & 2 and their counsel are also absent. Respondent No.3 as well as his counsel Mr B Lahiri are also absent. However, Proxy Adv.Mr Dhiman Chatterjee for Adv. Mr B Lahiri appeared and filed authority letter issued by Adv. Mr Lahiri.

 

The record reflects that the appellant as well as her counsel are absent since after granting the interim stay.  Thereafter interim stay was also vacated and on 07.04.2011, the matter was adjourned till today. Even though, the appellant as well as her counsel remained absent. 

 

Therefore, we have no other alternative except to dismiss the appeal in default. Accordingly, the appeal is dismissed in default.


          No order as to cost.

              Copy of this order be supplied to the parties.
