Per Mr.P.N.Kashalkar, Hon’ble Presiding Judicial Member

This appeal is filed challenging judgement and award passed by District Consumer Disputes Redressal Forum, Kolhapur in consumer complaint nos.559/2007 & 560/2007 and they have also mentioned that the appeal is also filed against the order passed in Recovery application nos.186/2008 & 187/2008.  By the said award deposit amounts are directed to be paid to both the complainants besides the cost of `500/- and further amount of `500/- for mental harassment has been awarded.  Upon hearing advocate for the appellant, we are finding that there is no merit in appeal though Mr.Deshinge is submitting that appellant Society is ready to deposit the amount in execution proceedings.  If society is ready to deposit the amount, then why they have come in appeal is a question mark.  In any view of the matter, there are no grounds to challenge the award passed by District Consumer Disputes Redressal Forum.  This was simply a consumer dispute between depositor and credit society and forum below has passed an order in favour of depositors since appellant society had failed to repay the deposit amounts with interest.  Thus, we are finding no merit in the appeal. Hence we pass following order:-

                                      ORDER

Appeal is summarily rejected.

Copies of the order be furnished to the parties.
