Heard Mr.Ashutosh Marathe, Advocate for the appellant and Mr.Anant Landge, Advocate Proxy for Mr.Pralhad Paranjape, Advocate for the respondent.  He files authority letter, taken on record.  Advocate Mr.Marathe files pursis stating therein that he wants to withdraw the appeal consequent upon amicable settlement reached between the parties out of Commission.  Respondent No.1 does not have any objection.  Hence, we pass the following order :-

                             -: ORDER :-

1.                 In view of pursis filed by Advocate Mr.Marathe for the appellant, appeal stands disposed of as withdrawn.

2.                 No order as to costs.

3.                 Amount deposited by the appellant for obtaining stay be returned to the appellant with accrued interest, if any.

4.                 Copies of the order be furnished to the parties.
