Per Mr.Justice S.B.Mhase, Hon’ble President

This matter was heard by the State Commission on 06/4/2010 and it was rejected.  Said order of the State Commission was challenged by way of revision petition no.2487/2010 before the National Commission.  Hon’ble National Commission has remitted back the matter to the State Commission and directed parties to remain present before the State Commission on 13/12/2010. In accordance with such direction respondent remained present before the State Commission on 13/12/2010.  However, the appellant was not present.  Appellant and their advocate were absent.  Therefore, appeal was adjourned to 12/1/2011.  Today also respondent is present, however, appellant and appellant’s advocate both are absent. No one reports their difficulty.  Under these circumstances appeal stands dismissed for non prosecution.  It is clarified that there is no stay granted by the State Commission while pendency of appeal.

It is further clarified that the stay granted by the National Commission was granted during pendency of revision petition.  However, thereafter it was not extended and as on today there is no stay to the order and the District Consumer Disputes Redressal Forum can proceed with the execution, if filed.
