Heard the learned counsel appearing for the applicant. None appeared for the respondent despite showing the name of the counsel appearing for the respondent in the cause list.

       This is an application for condoning the delay of 90 days in preferring the accompanying appeal. We have perused the statements made in the application. Also perused the objection filed on behalf of the respondent against the application for condonation of delay.

       Considering the matter in its entirety and also for the ends of justice, delay in preferring the appeal is condoned with a cost of Rs. 1000/-. The cost shall be paid to the respondent before admission of the appeal.

       Misc Case is allowed and disposed of accordingly.
