Heard Ms.T.Yangi, learned counsel for the petitioner – State Bank of India, Naya Bungalow Branch.
 
In the course of the hearing of the petition, the learned counsel for the petitioner submits that at this stage she is not inclined to press the revision petition, provided the matter relating to the limitation is kept open by this commission. We have perused the order of the learned District Forum which only condoned the delay and decided to hear the case on merit.
 
Considering the facts aspects of the matter and also considering the submission of the learned counsel, we are of the view that the Complaint Petition No.42(S)1995 required to be disposed off by the District Forum on merit. Accordingly we allow the petitioner to withdraw the petition and keeping the question of limitation open. If the petitioners are aggrieved by the final judgment of the authority, the petitioner may raise the issue of limitation at the time of hearing the petition.
 
With this, the revision petition is disposed off.
