The Revision Petitioner appeared in person and submitted that his Appeal filed before the M.P. State Consumer Disputes Redressal Commission (for short ‘State Commission’) was dismissed for non-prosecution on 16.01.2024.  He submitted that he is a resident of Gwalior and could not go personally and that the Counsel he engaged has not appeared for reasons not known to him and that he may not be denied for hearing for that reason. 

He submitted that he will appear personally and seek indulgence of the State Commission to appear thereafter through Video Conference before the State Commission.  He further sought that the State Commission may grant him legal assistance by way of appointment of an Amicus Curiae as he is not able to engage an Advocate to defend him. 

On perusal of record, it is seen that the Respondent/Opposite Party has not appeared before the Gwalior District Consumer Disputes Redressal Commission which had given an ex-parte Order on 06.09.2016.  Not being satisfied with the Order, the Petitioner filed his Appeal which was dismissed for non-prosecution.

In view of the submission made and on perusal of record, I consider this a fit case to be heard by the State Commission on merits.

The Order of the State Commission dated 16.01.2024 is set aside.

Parties to appear before the State Commission on 08.11.2024.

The Revision Petition is accordingly disposed of.
