          Adv. Nikhil Mehta is present on behalf of the Applicant/ Appellant.  Non-Applicant/Respondent in person is present.  Adv. Mehta for the Applicant/Appellant filed a pursis stating that he may be permitted to withdraw the delay condonation application and the appeal since the matter is settled outside between the Applicant/Appellant and the Non-Applicant/Respondent.  Non-Applicant/Respondent, who in person is present, has also given his ‘say’ to the effect that he has no objection for withdrawal of the present appeal by the Applicant/Appellant.  Non-Applicant/ Respondent has further stated that he has no objection to refund the amount deposited under Section-15 proviso of the Consumer Protection Act, 1986 to the Applicant/Appellant since the claim has been otherwise satisfied. In view of the fact that the Non-Applicant /Respondent is identified before us by Adv. Nikhil Mehta for the Applicant/Appellant on the basis of PAN Card, we allow the withdrawal of the appeal.  Registrar (Legal) is directed to release the amount deposited at the time of filing of the appeal by the Applicant/Appellant under Section-15 proviso of the Consumer Protection Act, 1986 to the Applicant/Appellant.  Miscellaneous Application No.462 of 2011 and Appeal No.756 of 2011 stands disposed of accordingly.
