Mr.V.M.Abhyankar-Advocate for the applicant/appellant.  Mrs.A.P.Pise-Advocate for the respondent.

This pursis has been filed by the appellant and both appellant and respondent and their advocates have signed the said pursis.  Advocate for the respondent Mrs.Pise has no objection to return the deposited amount.  Advocate for the respondent further states that she received this pursis, which was transmitted by the respondent through one Mr.Abdul Patel, who has come to her for filing caveat in the High Court and, thus, she has presented the said pursis to us.  Mr.Paranjape –Assistant Manager of the bank is present.  Since the pursis has been received signed by the respondent as stated above through one Mr.Patel, we asked the Bank officer whether he identifies signature of the respondent and he says that he identifies the signature of the respondent and, therefore, he has made an endorsement accordingly on the said pursis.  Thus, being satisfied with the signatures of the appellant and respondent, we dispose of the appeal along with delay condonation application as withdrawn.  Amount which is deposited by the appellant at the time of filing of the appeal under section 15 proviso be returned to the appellant after the period to file revision is over.
