                    Complaint passed over several times since morning. But none put in appearance on behalf of the complainant. It is already 03.00 P.M. No further wait is justified and possible. None appeared on behalf of the complainant on previous date to file rejoinder and evidence and to pay conditional cost of Rs.500/-.  The complainant has failed to appear on two consecutive dates. It seems that the complainant is not interested in prosecution of the complaint.

          The previous conduct of the complaint shows that despite restoration of the complaint he failed to file rejoinder and evidence. The complaint is fixed for rejoinder and evidence since 14.10.2015.

          Therefore, this Forum has no option except to dismiss the complaint in default for non-prosecution. Hence the complaint is dismissed in default for non prosecution. Copy of the order be sent to the parties as per rules. File be consigned.
