                   Heard the learned counsel for the appellant Mr. Ajay Kumar and for the respondent Mr. Pritam Kumar.

Respondent has filed Petition stating to the effect that the amount of Rs. 1,61,770/- (Rupees one lac, sixty one thousand and seven hundred seventy only) as found payable by the appellant-L.I.C. is acceptable to him. It is however, submitted that the above amount settled by the L.I.C ought to have been paid much earlier. The advocate for the appellant submits that the aforesaid amount could not be paid earlier since the present appeal was pending.

Considering the submissions of the parties. We accordingly direct the appellant to pay the aforesaid amount of Rs. 1,61,770/- along with a total sum of Rs. 3,000/- which includes compensation, interest as also litigation cost. As such the total amount of Rs. 1,64,770/- (Rupees one lac, sixty four thousand and seven hundred seventy only) be paid to the complainant within a period of two months, on receipt/production of the certified copy of the present order, failure to pay the amount within the aforesaid period interest @10% shall be payable till payment. The impugned order stands modified as above.

The appeal stands disposed of.
