(1)               There is a delay of 59 days in filing the appeal.  Hence, the application for condonation of delay and an affidavit in support thereof is made.  Adv.Jinsiwal for the appellant has produced the file which we had asked for.  On going through the file and affidavit, we are satisfied that the delay of 59 days is satisfactorily explained.  However, it can be condoned subject to certain costs. Holding accordingly, we pass the following order. 

ORDER

(1)     The application for condonation of delay bearing No.MA/11/44 is allowed subject to cost of `2,000/- to be payable by applicant/appellant to each non-applicant/respondent and delay in filing the appeal stands condoned
