Per Mr.P.N.Kashalkar, Hon’ble Presiding Judicial Member

None for the appellant and respondent

There is only one set given in this appeal. Two more sets were directed to be given by the appellant.  Those sets are not given.  Moreover, we are finding that this appeal is filed 7 years, 5 months and 15 days belatedly.  There is no just and sufficient cause mentioned in the condonation of delay application.  Some omnibus statements are made which cannot persuade us to condone delay of 7 years, 5 months and 15 days. Moreover, appellant is not pursuing the appeal diligently and therefore, in the totality of the circumstances, we are inclined to reject condonation of delay application. Hence the following order:-

Misc.application for condonation of delay stands rejected.

Consequently appeal does not survive for consideration.

Copies of the order be furnished to the parties.
