ORDER

Per Shri S.R. Khanzode, Hon’ble Presiding Judicial Member

 

          Mr.Ambadas Kandikonda, Advocate for the respondent files Vakalatnama and also filed address pursis of respondent/org. complainant, taken on record.

          There is delay of 26 days in filing appeal.  In the application, in para 4, chronological events are mentioned as to how the reflecting steps taken by the appellant to file appeal, but due to the fact that various offices are involved, the delay was caused due to administrative grounds. 

This application is opposed by the respondent.  However, considering the fact that the statement made by the applicant are not contradicted on facts, we find the facts stated by the applicant explaining the delay are to be accepted and thus, we find that the delay is satisfactorily explained.  It is not intentional nor any malafide could be attributed to the applicant and hence, we hold accordingly and pass the following order :-

                             -: ORDER :-

1.       Application is allowed.  Delay in filing appeal stands condoned subject to payment of cost of Rs.5,000/- payable to the respondent/org. complainant.

2.       Cost be paid within 45 days and failing which without further reference to this Commission, application stands dismissed automatically.

3.       Subject to payment of this cost within time, appeal No.479/2010 be listed for admission on 02/12/2010.
