The complaint is allowed with following reliefs:-

a) The Opposite Parties are jointly and severally directed to hand over the possession with respect ot flat no. S1 along with certified copy of Deed of Release and Occupancy Certificate upon the receipt of balance amount of Rs. 15,09500/- in favour of Complainant and to complete the formalities of registration of Sale Deed of suit flat by admitting its execution of or/and executing and registering a Deed of Rectification before the Sub-Registrar of Ponda.

b) The Opposite Parties are jointly and severally directed to pay the Complainant by way of interest @12 p.a. on the amount of Rs. 3,90,000/- paid to the OPs from the date of the receipt till handling over possession and execution of the Sale Deed.

c) The Opposite Parties are jointly and severally directed to pay Rs. 1,00,000/- as compensation to the Complainant towards mental stress and agony which he had to undergo due to the delay caused by the OPs in handling over the possession and execution of Sale Deed.

d) Prayer 'c' is rejected.

e) The OPs are also directed to pay Rs. 25,000/- to the Complainant towards the cost of the present litigation.

f) In case said amount of Rs. 1,00,000/- is not paid after the Appeal period, the same will carry interest @12% p.a. till payment.
