This case is covered by the decision of the Apex Court in the matter of Rajeev Hitendra Pathak and Others Vs.  Achyut Kashinath Karekar and Another ~ IV-(2011)-CPJ-35-(SC) = 2011-(5)-ALL M. R.-951-(SC).  Since the Commission has not empowerment to restore the matter, the application stands dismissed and disposed of, accordingly.  No order as to costs.
