(1)               Adv.Rahul Kolnoorkar appears for the respondent No.1.  He files Vakalatnama and memo of address of respondent No.1 which is taken on record.  Respondent No.2 is served, but today he is absent.  Hence, we proceed against him ex-parte.

 

(2)               There is a delay of 30 days in filing the appeal and hence Misc.Appllication No.251/11 has been filed for seeking condonation of delay supported with affidavit.  The appellant company has stated that the impugned order passed by the forum below was in Marathi language, the appellant officials in Delhi could not understand the contents of the order and the copy of the order was sent to the local lawyer at Mumbai for translation. The said translation was then sent to the appellant company at Gurgaon.  After reading the contents of the order, it was decided to file appeal and the lawyers took time to prepare appeal.  Therefore, there is a delay of 30 days in filing the appeal and requested that the same be condoned.     Under the circumstances, we find that the delay is explained by showing sufficient cause.   In the interest of justice, we are of the opinion that the delay occurred in filing the appeal should be condoned subject to payment of cost 1,000/-.   Hence order.

 

ORDER

 

(1)     Misc.Application No.251/11 stands allowed.  The delay in filing the appeal is hereby condoned subject to payment of cost `1,000/- payable by the appellant to the respondent.
