ORDER

As per record, OP No.1 not yet served. Vide separate statement of Ld. Counsel for complainant, this party deleted from array of parties, with liberty to the complainant to get this party served in future if occasion arises qua deciding this complaint/execution petition pertaining to it, if any, in future.

At this stage, a receipt (marked as mark ‘X’ for future reference) has been filed on behalf of complainant showing up to date payment of the vehicle in question (in short to be referred as vehicle) in compliance to order of Hon’ble State Commission dated 17.02.2022 passed a Revision Petition No.2/2022, titled as Shri Ram Transport Finance Company Ltd. versus Manoj Bansal (in short order of Hon’ble State Commission). Copy of this receipt supplied to Ld. Counsel for OP No.2.

The learned counsel Sh. M.L. Bhambhu, for OP No.2 has no objection if this main complaint, alongwith Misc Application No.1/2022, pertaining to it, is disposed of today finally subject to giving liberty to OP No.2 to get the main complaint/execution petition, pertaining to it, revived in future in case the complainant makes   default in payment of future installments of vehicle and particularly in compliance to above mentioned order of Hon’ble State Commission. The statement of Ld. Counsel for OP No.2 also recorded today separately to the above effect. The complainant and his Ld. Counsel have no objection to the above mentioned submission of Ld. Counsel for OP No.2 .

 

At this stage, the complainant and his surety respectively have filed their undertakings for making further payments of installments due to the OP No.2 of the vehicle, as per rules, and particularly in compliance to order of Hon’ble State Commission, mentioned above.

With these submissions from both sides, this main case, alongwith above mentioned misc. application, stand decided. A release order of the vehicle be issued in favour of complainant to get the vehicle released in his favour forthwith from the possession of OP No.2, for which Ld. Counsel for OP No.2 also agreed to release the vehicle forthwith on producing copy of this order/release order, by the complainant, in the office OP No.2, but during day time. Copy of this order be given to both sides free of cost as per rules. The main file, alongwith misc. file, be consigned to the record room as per rules after due compliance.
