2.       TCNS Clothing Company Pvt. Ltd., Regd. Office 3 Community Centre, Saket,New Delhi-110017 through its Manager/Director/Authorized Signatory.

                    Arguments on the ground of the locus standi of the complainant to file the present complaint, at the preliminary stage, have been heard.  The complainant has argued that since he had made the payment through his card for the purchase of the product in question but the bill was generated by the OP in the name of some another person and as such he has got every locus standi to file the present complaint.

2.           However, we are not convinced with his arguments because if the name of other person than the complainant was mentioned on the invoice as alleged, then he could have very easily get it corrected from the OP at that particular point of time or thereafter but he did not do so.  Since, the bill dated 14.01.2017 qua the product in question annexed with the complaint was generated in the name of one Sh.Shubneet and not in the name of the complainant and as such it is Sh.Shubneet who has got locus standi to file the complaint against the OP. In view of the above discussion, the complainant has got no locus standi to file the instant complaint before this Forum.
3.           For the reasons recorded above, the complaint is dismissed at the preliminary stage, with no order as to costs.
4.           The certified copy of this order be sent to the parties free of charge, after which the file be consigned.
