Balwinder Kaur aged about 34 years wife of Jaswinder Singh, resident of Village Agaul, District Patiala (Adhaar card No. 3048 5719 0048).

2.        Shree Ganeshdev Micro Credit, Regd. Office: Ward No.07, Khagaul Road, Phulwari Sharif, Patna 801505 (Bihar). (Complaint against OP Number 2 was withdrawn on 13.3.2023).

ORDER

SARITA GARG, MEMBER.

1.             Complainant has approached this Forum/Commission alleging inter-alia that the complainant availed services of OPs by investing a  sum of Rs.1,00,000/- on 25.01.2016 in the shape of FDR with the OPs  and the OPs issued   FDR    certificate    bearing   Member ID No.101M00000488 dated 25.1.2016 and the OPs were liable to pay Rs.2,00,000/- on maturity after 6 years. Continuing further, the complainant has also alleged that after expiry of the deadline, she approached various officials of the OPs and requested them to release the maturity amount but latter failed to do the needful and this is how they were clearly deficient in their services.  Even thereafter the complainant approached various authorities on numerous occasions but when nothing was done by the OPs then she was constrained to approach this Forum/Commission with a request for directing the Ops to release a sum of Rs.2,00,000/- along with interest and also for Rs.50,000/- on account of mental harassment and inconvenience and Rs.11,000/- as litigation expenses.

2.             Record shows that OP number 1 did not appear despite service, as such was proceeded against exparte on 10.01.2023. Further the complainant withdrew the complaint against OP number 2 on 10.01.2023 as per the statement of learned counsel for the complainant which is on record.

3.             The learned counsel for the complainant produced  Ex.C-1 affidavit of complainant, Ex.C-2 copy of fixed deposit receipt and closed evidence.

4.             We have gone through the pleadings put in by the learned counsel for complainant along with supporting documents with his valuable assistance.

5.             In order to prove case the complainant has placed on record Ex.C-2 copy of Fixed Deposit Receipt  of the above said amount of Rs.1,00,000/-  and Ex.C-1 is the detailed affidavit of complainant. Moreover, from the perusal of the receipt Ex.C-2 it has been proved that the complainant has deposited the amount of Rs.1,00,000/- with the opposite parties as per scheme and the OPs were liable to pay an amount of Rs.2,00,000/- to the complainant after lapse of six year i.e. on 25.1.2022. All these facts have clearly been mentioned on the fixed deposit receipt Ex.C-2.  There is no explanation from the side of the OPs that why they did not pay the maturity amount of Rs.2,00,000/- to the complainant, so we find that the complainant is entitled to get the maturity amount of Rs.2,00,000/- from the OP number 1.

6.             As a result of the above discussion, the present complaint is allowed and opposite party number 1 is directed to pay to the complainant the maturity amount of Rs.2,00,000/- alongwith interest @ 7% per annum from the date of maturity i.e. 25.1.2022 till its realization. Further, OP number 1 is  also directed to pay Rs.5000/- as compensation on account of mental agony and harassment and an amount of Rs.5000/- as litigation expenses to the complainant. Compliance of the order be made within the period of 60 days from the date of the receipt of the copy of this order.

7.             The complaint could not be decided within the statutory time period due to heavy pendency of cases.

8.             Copy of this order be supplied to the parties free of cost. File be consigned to the records after its due compliance.      

                        Pronounced.
