Learned counsel for the appellant as well as learned counsel for respondent No. 1/1 has appeared.

Today learned counsel for respondent No. 1/1 has submitted the bill (paper No. 69) according to which the arrear of the electricity bill as mentioned has been paid by the above document.

Learned counsel for the appellant has noted down to the side of such document that the arrears of electricity bill has already been paid by the respondent.

If the entire electricity bill payment has been made, then it would be deemed that there was no fault on the part of the electricity department, hence in such circumstances, the appeal is allowed and the impugned judgment is hereby set aside.  No order as to costs of the appeal.

File be consigned to the record room alongwith copy of this order.

A copy of this order be sent to the concerned District Commission for perusal, information and necessary action.
