Case has been called several times since morning and ultimately 3.00 pm., but none appeared on behalf of the applicant. On the last date of hearing also, none appeared on behalf of the applicant. Sh.Davinder Singh Walia, Manager of the respondent appeared got recorded his statement that as a matter of goodwill gesture, no doubt, the amount of repair of the LCD of the applicant is Rs.15427/-, however, the respondent as a result of compromise, is ready to repair the LCD of the applicant on payment of Rs.13000/- only. All this shows that applicant is not interested in prosecuting the present execution application. Resultantly, the present execution application is dismissed in default for want of prosecution. File is ordered to be consigned to the record room.
