Final Order / Judgement

The Complainant is present in person.

The Op is present through the Ld. Advocate.

Today is fixed for filing reply on affidavit by the Complainant.

Today the Complainant has filed an application with copy to the other side on affidavit stating that the Complainant is not inclined to proceed further with this Complaint on the ground that his grievance has already been redressed by the Op out of Court.

According to the Complainant if this application is not allowed, he will suffer irreparable loss and injury and prayer is made by the Complainant for allowing this application.

We have carefully perused the content of the application. In our view this Complaint was filed by the Complainant to redress his grievance but at this juncture the Complainant is not willing to proceed further with this Complaint on the ground that his dispute has been resolved by the Op by way of amicable settlement. We have no objection to allow the prayer as made out by the Complainant in the application filed today.

            Hence it is ordered,

That the Consumer Complaint being no. 08/2019 is hereby disposed of as withdrawn, prayed for by the Complainant on the application filed today  by him. Considering the facts and circumstances there is no order as to costs.

Let plain copy of this final judgment be given to the parties free of cost as per the CPR, 2005.
