ORDER

This revision petition has been filed by the revision petitioners/opposite parties against order dated 28.01.2019 passed by District Consumer Disputes Redressal Forum-II, U.T., Chandigarh (in short ‘the Forum’) vide which, exparte proceedings were ordered against the revision petitioners/opposite parties for not putting in appearance on the date fixed.

2.             Service is complete.

3.             Sh. Harsh Goyal, Advocate has put in appearance on behalf of the respondent/complainant by filing his Vakalatnama, which is taken on record.

4.             It is stated by the Counsel for the revision petitioners/opposite parties  that reply and evidence/affidavit is ready and it will be filed in the Forum on the next date of hearing.

5.             Counsel for the respondent/complainant took up a very fair stand stating that let the complaint be decided on merits.

6.             We appreciate the view expressed by the Counsel for the respondent/complainant.

7.             Accordingly, the revision petition is allowed. Order dated 28.01.2019, under challenge is set aside. The revision petitioners/opposite parties shall file reply and evidence/affidavit before the Forum on the next date of hearing, failing which, no further opportunity shall be granted for the said purpose.

8.             Order passed is subject to payment of cost of Rs.2,000/- by the revision petitioners/opposite parties to the respondent/complainant on the next date of hearing fixed before the Forum i.e. 13.03.2019.

9.                Parties are directed to appear before the Forum concerned on 13.03.2019.

10.           Complete record of complaint file be sent back to the Forum concerned alongwith certified copy of this order, so as to reach there before the date fixed.

11.           Certified copies of this order be sent to the parties, free of charge.

12.           File be consigned to the Record Room after completion.
