Shri Ashok Joshi, aged about 53 years, s/o Shri SL Joshi, r/o Deewan Street, Malerkotla, District Sangrur, Punjab

1.      Shivalik Vihar Sites Private Limited, through its Managing Director, Head Office: SCO No. 16-17, 2nd Floor, Sector 34-A, Chandigarh U.T.

2.      Shri Anil Kumar, Managing Director, Shivalik Vihar Sites Private Limited. Head Office: SCO No. 16-17, 2nd Floor, Sector 34-A, Chandigarh U.T

3.      LIC Housing Finance Limited, through its Branch Manager, Area office; SCO Nos 2445-2446, Sector 22-C, Chandigarh U.T. 160 022

                        Sh.Anil Kumar, OP-1 and 2 in person alongwith Sh.O.P. Narang, Adv. for OPs.

 

Dated, the 15th day of October, 2010.

                                                            ORDER

                            This case has been taken up today in the Lok Adalat. Efforts were made to settle the matter, which stood fructified and the parties have settled the dispute. Statement given by them is reproduced as under:-

“Statement of Sh.Anil Kumar, OP-1 and 2 in person identified by Sh.O.P. Narang, Adv. for OPs

 

The matter has been settled between the parties. The OPs bind themselves to deliver the vacant physical possession of flat no. 213, Second Floor, Shivalik apartments, Kharar, Mohali, Punjab to the complainant and for execution of the sale deed, within two months from the date of realization of Cheque no. 980097 dated 15.11.2010 drawn on the Canara Bank, Sector 20, Panchkula Branch for a sum of Rs.1,89,888/-  being the full and final payment, as given by the complainant, for the said flat in question.

 

Statement of Sh.Ashok Joshi, complainant in person identified by Sh.N.P. Sharma, Adv. for complainant.

 

I accept the above statement of Sh.Anil Kumar, OP-1 and 2 in person. I also bind myself to get the sale deed executed for the flat in question within a period of two months from the encashment of above said cheque.  I have got issued the above said cheque in question from my brother Sh.P.S. Joshi, complainant in complaint no. 1543 of 2009 and I have full intentions of getting the said instrument honored on my behalf. Hence I withdraw the present complaint as fully satisfied”.

 

2.                     In view of the above statements, the complaint stands dismissed as withdrawn. However, the parties would remain bound by their statements.

 

3.                     Copies of this order free of cost be supplied to the parties. The file be consigned.
