2.   IFB Industries Limited, Regd. Office at 14, Taratolla Road, Kolkata-700088 through its authorised signatory.

3.   IFB office at Plot No. 640-A, Phase-IX, SAS Nagar through its authorised signatory.

                     None for OP No.1.

                     Shri Hakam Chand Sharma, Authorised Representative of OPs No.  2 and 3.

 

          Today the case is fixed for consideration on the application seeking directions to the Complainant to produce of the original boxes containing printing dates of delivery of the product etc.  At this stage, Shri Hakam Chand Sharma, Authorised Representative, on the instructions of OPs No. 2 and 3, by making a separate statement, stated that OPs No. 2 and 3 have paid an amount of Rs. 45655/- by way of a Cheque bearing No. 934653 dated 22.07.2021 drawn on HDFC Bank, to the Complainant, as full and final settlement. In this regard, he tendered on record the Compromise Deed as ‘Mark ‘A’ duly signed by both the parties, and prayed that the present complaint may be dismissed in view of the settlement made with the Complainant.

          On the other hand, the Complainant, by making a separate statement, stated that he has gone through the statement made by the Authorised representative of the OPs No.2 and 3, as well as the contents of Compromise Deed Mark ‘A’ which bears his signature also, and agreed with the same. He further stated that today, he has received an amount of Rs.45655/- by way of a Cheque bearing No. 934653 dated 22.07.2021 drawn on HDFC Bank, as full and final settlement; now, nothing is due against the OPs; hence, he withdraws the present complaint, being fully satisfied.

          Heard.  In view of the statements made by the both the parties, the present Complaint is hereby ordered to be dismissed as withdrawn, being fully satisfied.

                     A copy of this order be sent to the parties, free of costs and File be consigned to the record room, after due compliance.
